Privacy and Security Policy – MotionBank

PT Bank MNC Internasional Tbk is licensed and supervised by the Financial Services Authority (Otoritas Jasa Keuangan) domiciled in Central Jakarta and has branch offices spread across the territory of the Republic of Indonesia (“MNC Bank”) realize to necessarily keep and protect data security and MNC Bank’s Customer data and information (“You” or “Customer”) as a user of MotionBank services. MNC Bank prepared this Policy in order to explain to you how MNC Bank obtain, process, keep, use, display, deliver, distribute, remove and destroy the Personal Data that you provide to MNC Bank when downloading, uploading, accessing, and using MotionBank services, unless stipulated otherwise in separate policy.
We expect You to read and acknowledge all conditions that stipulated in the Privacy and Security Policy – MotionBank (“Policy”) which an integral and inseparable part with the Terms and Conditions of MotionBank. Terminologies in the capital letter have the same definition as stipulated in the MotionBank Terms and Conditions.

In regards with the aforementioned, therefore MNC Bank set the Policy as follows:

I. Privacy Policy

1. In this Policy “Personal Data” shall mean data, information and/or information in any form that is attached and could be identified, either directly or not on each Customer who uses MotionBank services, which from time to time is submitted to MNC Bank in, on and/or through MotionBank which include but not limited to: (i) full name; (ii) identity card number; (iii) address; (iv) date of birth and/or age; (v) the cell phone/mobile phone number used; (vi) biological mother’s name; (vii) email address; (viii) data regarding Customer’s banking transactions at MotionBank; and/or (ix) other data that include or could be identified as Personal Data.

2. The Customer acknowledge that submitting Personal Data to MNC Bank is conducted voluntarily. If the Customer is not willing to provide Personal Data, then the Customer acknowledge that MNC Bank may not process Personal Data for the purposes set out in this Policy, and may cause MNC Bank to be unable to provide services or products to or process your transaction.

3. Collecting Personal Data
a. MNC Bank represent that shall keep the secrecy of Personal Data in collecting Personal Data limited only for the purposes of processing Personal Data stipulated in this Policy and the prevailing laws;
b. MNC Bank collect Personal Data when you: (i) registering MotionBank; (ii) altering Personal Data; (iii) accessing MotionBank services or transacting through MotionBank; (iv) or at any other times as may be requested by MNC Bank (if required) from time to time.

4. Processing Personal Data
MNC Bank may process and/or use Personal Data for the purposes mentioned below or other purposes as permitted in the applicable laws and regulations.
a. To identify and register Yourself as the user of MotionBank services and to verify, deactivate or maintain Your account, including to perform the Know Your Customer principle;
b. To allow MNC Bank to provide service, product or transaction that You conduct to be processed;
c. To mitigate, detect, investigate and handle to all possibilities action which recognized as crime, forbidden, illegal, unlawful, that may be arises while using MotionBank, including but not limited to fraud, money laundering, or any other crime;
d. To the administrative necessity of Your account;
e. To conduct research regarding demography data of the Customer;
f. To the internal administrative necessity, such as: audit, data analysis, records in database;
g. To evaluate, analyse, verify, validate or examine against transaction request through MotionBank (including lending – if any) and/or Your profile;
h. To be used, given, disclosed to third parties and/or affiliates of the MNC group for the purposes of research analysis and/or improvement/addition of products and services as it may require according to the prevailing laws;
i. To carry out verification, risk assessment, statistical and trend analysis and planning, including to carry out data processing, statistical analysis, credit, risk monitoring and anti-money laundering, creating and managing credit assessments, conducting credit and other background checks and reviews and record valid transaction for current and future reference;
j. To maintain relationship between the Bank and You, among others for the following matters:
(i) identify Yourselves while You communicating the Bank or using MotionBank; (ii) communicate with You regarding Your request; (iii) deliver notifications via electronic mail (email) to You; (iv) for transaction purposes in general including to verify Your identity; (v) address inquiries or complaints made by or about You in relations with MotionBank and shall be stored to mitigate and detect fraud, violations and other forms of abuse; (vi) verify Your compliance with the terms and conditions governing the use of MotionBank; (vii) conduct or carry out surveys, research, evaluations, academic studies and/or development of MotionBank, products or services by the Bank; (viii) conduct any investigations based on prevailing laws regarding anti-money laundering and counter-terrorism financing in the financial services sector; (ix) to fulfill the requirements by the laws, regulation and compliance prevail to the Bank according to the prevailing laws and to comply each prevailing agreement regarding the MotionBank; (x) carry out orders or policies of government, regulatory agencies or competent authorities; and (xi) to notify You regarding the alteration to the MotionBank

II. Security Policy

1. MNC Bank shall require You to enter a Passcode in order to access the MotionBank service. To ensure security while accessing MotionBank, then You are required to conduct the followings:
a. When You firstly enter Your MNC Bank Debit Card / MNC Bank Credit Card number, then MNC Bank suggest to not use predictable information, such as date of birth, vehicle registration number, telephone number and so on. If You feel that Your Passcode and/or Personal Identification Number (“PIN”) disclosed to or known by third party, loss, stolen and unauthorized transaction may have occurred, You are responsible to immediately report it to MNC Bank;
b. To keep the security of Passcode and PIN of MotionBank and not to disclose, distribute or write down the Passcode and PIN to any other party. You must secure your Passcode and PIN to: (i) not disclose your Passcode and PIN to other party; (ii) not record Passcode and PIN on paper or store it in writing or any other storage facilities that may be known by other party; (iii) cautiously input Passcode and PIN to ensure unknowable by other party; (iv) alter the PIN periodically; (v) not input PIN that is given by other party or predictable;
c. To not disclose the PIN or part of the PIN to any other party, even if the party claim as an employee or appointed by MNC Bank. MNC Bank shall never inquire Your Passcode and PIN, only You are allowed to know this information.
d. To protect Customer’s access and transactions while using MotionBank services, MNC Bank is applying the following security systems:
1) Secure Socket Layer (“SSL”) is a security technology that “scrambles” communication lines among computers, so that it shall be unreadable by other parties. The MNC Bank network (web) security area is applying 256-bit SSL encryption technology to protect communication among the Customer’s device (gadget/device) and the MNC Bank server while accessing MotionBank services;
2) Passcode and PIN;
3) One-Time Password (OTP) is a security technology that always generates a different password each time it is used for certain transactions.

2. To improve Your security, the time out session method is applied, means if after a period of 5 (five) minutes there is no Customer activity, then access will automatically logged-off or disconnected.

3. To use the MotionBank service at present, the recommended minimum cellular phone/handphone operating system specifications: (i) for Android OS: 4.1; and (ii) iOS: 6.0. MNC Bank reserve to alter the specification required in order to use MotionBank services by notify to the Customer in accordance to the prevailing laws.

4. Data Retention and Security
a. MNC Bank assure that the Personal Data submitted by the Customer shall be securely stored in accordance with MNC Bank’s internal policies and the prevailing laws of the Republic of Indonesia. MNC Bank shall store the Personal Data submitted by the Customer as long as necessary to fulfill the purposes stated in this Policy;
b. As long as it does not conflict with the applicable laws and regulations, MNC Bank will stop storing and will immediately delete and/or destroy Personal Data after it is deemed that processing of Personal Data is no longer necessary based on the purposes stated in this Policy.

III. Disclosure of Personal Data

MNC Bank realize to comply the following conditions as stipulated in this Policy and shall always keep it confidential, however in order to perform the objective as stipulated in the Policy, You acknowledge that MNC Bank reserve to disclose Your information to third party referring to the followings condition:
1. Allowed or approved by you;
2. Required, enacted or needed to implement Bank’s compliance in accordance to the prevailing laws.

IV. Approval Revocation

As long as it does not contradicted according to the prevailing laws, the Customer has the right to withdraw or revoke approval either partly or wholly in relations with disclosing Personal Data which may be submitted to the Bank in writing addressed via email as follows: cs@motionbank.id

V. Deletion Personal Data

Deletion Personal Data at MNC Bank shall be carried out according to the followings:
1. the purpose of processing Personal Data has been fulfilled and Personal Data shall not be used anymore in accordance to the Bank’s retention policy or in accordance with other prevailing laws that specifically regulate such conditions; or
2. upon the Customer’s request, unless stipulated otherwise by the prevailing laws.

VI. Limitation

1. You acknowledge that in the event of a situation as mentioned below, shall be deemed as events occured beyond the control of MNC Bank’s capabilities:
a. Whereas a natural disaster or unexpected activity occured, causing damage or destruction of equipment and/or system applied to securing, storing and processing Personal Data of the Customer;
b. Whereas the Personal Data is available or may be found publicly prior to the Personal Data is submitted to the Bank;
c. Whereas the Bank had already deliver its utmost best effort to verify, secure and protect the Personal Data, and in the event of any unlawful acces, hacking, misconduct, modification, disturbance;
d. Due to accuracy (unless the Personal Data had been verified by the Bank according to its policy), validity, legality and completeness of Your Personal Data; and/or
e. Whereas any misconduct of the Personal Data and information caused by crime act, fraud or any other crime act or failure from third party which remain in no surveillance of or instruction by the Bank.

2. The Bank will make reasonable efforts to notify you in writing via electronic mail (email) or other means of communication registered with the Bank, if there is a failure to protect Personal Data in the management of MotionBank, in accordance with the provisions of the prevailing laws.

VIII. Policy Alteration

1. Customer acknowledge that this Policy may be altered by the Bank from time to time and will be notified to the Customer no later than 30 (thirty) working days prior to the effectiveness of the alteration, addition and/or adjustment for this Policy.

2. If during the notification period above, the Customer does not object to the alteration, additions and/or adjustments to this Policy, then the Customer is deemed to have agreed. However, if Customer disagree to it, then after the Customer fulfill its obligations to MNC Bank, the Customer reserve to terminate the use of MotionBank in accordance with the MotionBank Terms and Conditions.

3. Any notification from the Bank will be delivered in writing or verbal to Customer’s address that recorded in the Bank’s data. The notification by the Bank may also be stated on bulletin board located at each branch office of the Bank, print media, electronic media, or other media. Submission of this notification refers to the regulations of the prevailing laws.

IX. Miscellanous

1. This Policy shall be conducted and interpreted according to the laws of Republic of Indonesia.

2. The Policy made in English version is for translation purpose only, in the event of misintepretation arises, the Policy in Bahasa Indonesia version shall prevail (please refer to Kebijakan Privasi dan Pengamanan – MotionBank).
